The General Data Protection Regulation\u00a0(GDPR) refers to the processing of personal data as the processing of personal data.<\/p>\n<h4 id=\"legal bases\">2.2 Legal bases<\/h4>\n<p>We process personal data in accordance with Swiss data protection law, in particular the <a id=\"118738\" href=\"https:\/\/www.fedlex.admin.ch\/eli\/oc\/2022\/491\/de\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Federal Act on Data Protection<\/a> (Data Protection Act, DPA) and the <a href=\"https:\/\/www.fedlex.admin.ch\/eli\/oc\/2022\/568\/en\" target=\"_blank\" rel=\"nofollow noopener\">Ordinance on Data Protection<\/a> (Data Protection Ordinance, DPO).<\/p>\n<p><span id=\"rechtsgrundlagen-dsgvo\">We process &#8211; if and insofar as the General Data Protection Regulation (GDPR) is applicable &#8211; personal data in accordance with <em>at least<\/em> one of the following legal bases:<\/span><\/p>\n<ul>\n<li><a href=\"https:\/\/steigerlegal.ch\/dsgvo\/dsgvo-6\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Art. 6 para. 1 lit. b GDPR<\/a> for the necessary processing of personal data for the performance of a contract with the data subject and for the implementation of pre-contractual measures.<\/li>\n<li>Art. 6 para. 1 lit. f GDPR for the necessary processing of personal data in order to protect our legitimate interests or those of third parties, except where such interests are overridden by the fundamental freedoms and rights and interests of the data subject. Legitimate interests are, in particular, our interest in being able to carry out our activities and operations in a permanent, user-friendly, secure and reliable manner and to communicate about them, to ensure information security, to protect against misuse, to enforce our own legal claims and to comply with Swiss law.&lt;\/li<\/li>\n<li>Art. 6 para. 1 lit. c GDPR for the necessary processing of personal data to fulfill a legal obligation to which we are subject under any applicable law of member states in the European Economic Area (EEA)<\/li>\n<li>.<\/li>\n<li>Art. 6 para. 1 lit. e GDPR for the necessary processing of personal data for the performance of a task carried out in the public interest<\/li>\n<li>.<\/li>\n<li>Art. 6 para. 1 lit. a GDPR for the processing of personal data with the consent of the data subject<\/li>\n<li>.<\/li>\n<li>Art. 6 para. 1 lit. d GDPR for the necessary processing of personal data in order to protect the vital interests of the data subject or of another natural person<\/li>\n<li>.<\/li>\n<\/ul>\n<h3 id=\"type-scope-purpose\">3. type, scope and purpose<\/h3>\n<p>We process the personal data that is <em>required<\/em> in order to be able to carry out our activities and operations in a permanent, user-friendly, secure and reliable manner. Such personal data may fall into the categories of inventory and contact data, browser and device data, content data, meta or marginal data and usage data, location data, sales data as well as contract and payment data in particular.&lt;\/p<\/p>\n<p>We process personal data for the <em>duration<\/em> required for the respective purpose(s) or by law. Personal data that no longer needs to be processed is anonymized or deleted.&lt;\/p<\/p>\n<p>We may have personal data <em>processed by third parties<\/em>. We may process personal data jointly with third parties or transfer it to third parties. Such third parties are, in particular, specialized providers whose services we use. We also guarantee data protection for such third parties.&lt;\/p<\/p>\n<p>We only process personal data <em>in principle<\/em> with the consent of the data subjects. If and to the extent that processing is permitted for other legal reasons, we may refrain from obtaining consent. For example, we may process personal data without consent in order to fulfill a contract, to comply with legal obligations or to protect overriding interests.&lt;\/p<\/p>\n<p>In this context, we process in particular information that a data subject provides to us <em>voluntarily<\/em> when making contact\u00a0&#8211; for example by post, email, instant messaging, contact form, social media or telephone\u00a0&#8211; or when registering for a user account. We may store such data in an address book, in a customer relationship management system (CRM system) or with comparable tools, for example. If we receive data about other persons, the transmitting persons are obliged to guarantee data protection for these persons and to ensure the accuracy of this personal data.<\/p>\n<p>We also process personal data that we receive from third parties, obtain from publicly accessible sources or collect in the course of our activities and operations, if and to the extent that such processing is permitted for legal reasons.&lt;\/p<\/p>\n<h3 id=\"applications\">4. applications<\/h3>\n<p>We process personal data about applicants to the extent necessary to assess their suitability for an employment relationship or for the subsequent execution of an employment contract. The required personal data results in particular from the information requested, for example as part of a job advertisement. Personal data abroad<\/h3>\n<p>We process personal data <em>in principle<\/em> in Switzerland and the European Economic Area\u00a0(EEA). However, we may also export or transfer personal data to other countries, in particular to process it or have it processed there.&lt;\/p<\/p>\n<p>We may export personal data to all <a href=\"https:\/\/de.wikipedia.org\/wiki\/Liste_der_Staaten_der_Erde#Tabelle\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">states and territories on Earth<\/a> and elsewhere in the <a href=\"https:\/\/www.datenschutzpartner.ch\/2022\/04\/23\/datenschutzerklaerung-daten-export-universum-mond\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">universe<\/a>, provided that the local law according to <a href=\"https:\/\/steigerlegal.ch\/2022\/09\/10\/ndsg-schweiz-staatenliste\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">decision of the Swiss Federal Council<\/a> provides for adequate data protection and\u00a0&#8211; if and to the extent that the General Data Protection Regulation\u00a0(GDPR) is applicable\u00a0&#8211; in accordance with <a href=\"https:\/\/commission.europa.eu\/law\/law-topic\/data-protection\/international-dimension-data-protection\/adequacy-decisions_en\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">decision of the European Commission<\/a> ensures adequate data protection.<\/p>\n<p>We may transfer personal data to countries whose laws do not guarantee adequate data protection, provided that data protection is guaranteed for other reasons, in particular on the basis of standard data protection clauses or with other suitable guarantees. Exceptionally, we may export personal data to countries without adequate or appropriate data protection if the special requirements under data protection law are met, for example the express consent of the data subjects or a direct connection with the conclusion or execution of a contract. We will be happy to provide data subjects with information about any guarantees or provide a copy of any guarantees upon request.&lt;\/p<\/p>\n<h3 id=\"rights\">6. Rights of data subjects<\/h3>\n<h4 id=\"ansprueche\">6.1 Data protection claims<\/h4>\n<p>We grant data subjects all rights in accordance with the applicable data protection law. We may inform data subjects of any requirements that must be met in order to exercise their rights under data protection law. Data subjects are obliged to cooperate.&lt;\/p<\/p>\n<h4 id=\"Beschwerdeecht\">6.2 Right to lodge a complaint<\/h4>\n<p>Affected persons have the right to enforce their data protection claims through legal action or to lodge a complaint with a competent data protection supervisory authority.&lt;\/p<\/p>\n<p>The data protection supervisory authority for private controllers and federal bodies in Switzerland is the <a href=\"https:\/\/www.edoeb.admin.ch\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Federal Data Protection and Information Commissioner<\/a>\u00a0(FDPIC).<\/p>\n<p>Affected persons have\u00a0&#8211; if and insofar as the General Data Protection Regulation\u00a0(GDPR) is applicable\u00a0&#8211; the right to lodge a complaint with a competent <a href=\"https:\/\/edpb.europa.eu\/about-edpb\/about-edpb\/members_de\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">European data protection supervisory authority<\/a>.<\/p>\n<h3 id=\"security\">7. data security<\/h3>\n<p>We take appropriate technical and organizational measures to ensure data security appropriate to the respective risk. Use of the website<\/h3>\n<h4 id=\"cookies\">8.1 Cookies<\/h4>\n<p>We may use cookies. Cookies\u00a0&#8211; our own cookies (first-party cookies) as well as cookies from third parties whose services we use (third-party cookies)\u00a0&#8211; are data that are stored in the browser. Such stored data need not be limited to traditional cookies in text form.&lt;\/p<\/p>\n<p>Cookies can be stored in the browser temporarily as &#8220;session cookies&#8221; or for a certain period of time as so-called permanent cookies. &#8220;Session cookies&#8221; are automatically deleted when the browser is closed. Page Insights provide information about how visitors interact with our Facebook presence.
